California Rest Area & Parking Rules
California caps you at 8 hours in any 24-hour period (21 CCR 2205), and camping is flatly banned. Overnight sleeping inside that 8 hours is allowed. The rule says nothing about federal hours-of-service, so a time-limit overstay has no written HOS defense - in practice a CHP officer usually tells you to move before writing anything. Truck spaces on I-5, I-10, and SR-99 fill by dusk. This is a reference, not legal advice.

Limits, truck parking, and HOS rest
- Time limit: 8 hours in any 24-hour period
- Among the worst truck-parking shortages in the country (Jason's Law). Rest-area truck spaces on I-5, I-10, and SR-99 fill by early evening, and Caltrans closes rest areas for maintenance with little notice. Real-time availability exists only on limited pilot corridors, not statewide.
- hosException: not addressed - 21 CCR 2205 is silent on federal HOS, so an overstay has no written defense. Dual lens: the 8-hour limit is on the books, but enforcement is usually 'move along' first, with a citation only if you refuse or set up camp. CHP inspection/weigh facilities are not for overnight rest. Camping (tents, campfires) is expressly prohibited.
What overstaying costs
Usually you're just told to move on; refusal or camping can draw a CHP citation and/or tow. No verified fixed dollar amount.
