Who stops, how far, and the CDL risk
- Who must stop: Placarded + buses
- Stop distance: Not less than 15 feet and not more than 50 feet from the nearest rail (VTL 1171; 49 CFR 392.10). One stop in that band, then look and listen. Don't creep forward onto the tracks while you wait.
- Clearance rule: Cross only in a gear that clears the whole crossing, and never shift gears while any part of you is on the tracks (VTL 1171). Don't roll onto a crossing unless the far side is open and you can drive completely across without stopping. Getting boxed in on the rails is a disqualifying offense (49 CFR 383.51).
- Fine & CDL disqualification: Up to $150 and 5 points for a first offense, up to $500 for a second within 30 months, and up to $750 for a third, plus the state surcharge (VTL 1171). Separate from the ticket, the FMCSA CDL disqualification (49 CFR 383.51) applies: at least 60 days for a first violation, 120 days for a second within 3 years, and 1 year for a third.
