How Montana handles work zones

Montana ties the double to the crew. The posted work-zone limit stands whenever the signs are up, but your fine only doubles when a highway worker is in the zone and within 1,000 feet of the violation (MCA 61-8-314). No worker in range and you pay the normal, low Montana speeding fine. Obey the flag person's directions (61-8-201). Montana has no statewide handheld ban, but FMCSA still bars handheld use for CDL drivers.

Speed, fines, phone, and the flagger

• Speed rule: The posted work-zone limit applies whenever the zone is signed. The penalty doubles only when a highway worker is actually in the zone and within 1,000 feet of your violation (MCA 61-8-314). Workers-present trigger for the enhancement; no worker in range, ordinary penalty.
• Fine multiplier: Doubled when a worker is present. The fine is at least double the underlying violation's penalty if a highway worker is in the work zone and within 1,000 feet of the violation (MCA 61-8-314). No worker present, you pay the ordinary penalty.
• Phone in a work zone: Covered by the general handheld rule
• Flagger authority: You must obey a flag person's directions; MCA 61-8-201 requires drivers to follow official traffic-control devices unless a peace officer, flag person, crossing guard, or public safety worker directs otherwise, so the flagger carries that authority. Disobeying is citable.
• Base fine: Montana's base speeding fines run low, often $20 to $70 (MCA 61-8-725); at least doubled when a highway worker is within 1,000 feet of the violation.
