Who you move over for, and the fallback
- Move over for: Police, fire, ambulance, tow trucks, and NDDOT/highway maintenance vehicles, plus (since 2023) any stopped motor vehicle displaying hazard warning lights. Applies on the interstate and on multi-lane divided highways outside city limits.
- If you can't move over: Move to a lane not adjacent to the stopped vehicle if you can do it safely. If you can't, reduce speed to a safe and reasonable level for conditions until you're past it.
- 2023 expansion added any hazard-lit vehicle (a family with a flat, a utility crew) to the older responder/maintenance duty, so older 'responders only' summaries are outdated. Note for drivers: it only applies on the interstate and multi-lane divided highways outside town, not on ordinary two-lane roads.

Blowing past an emergency or highway maintenance vehicle is $50 and 2 points. A stopped vehicle showing hazards is $20 and 0 points. Causing a crash bumps it to an infraction with steeper penalties.
