Who you move over for, and the fallback
- Move over for: Any stopped, standing, or parked vehicle displaying hazard warning signal lamps, road flares, or caution signals including cones, caution signs, or reflective triangles. This covers disabled and private vehicles, not just emergency and tow trucks. The older duty to move over for authorized emergency vehicles stays on the books separately (K.S.A. 8-1530).
- If you can't move over: On a highway with two or more lanes your way, change into a lane not adjacent to the stopped vehicle if it's possible and safe. If you can't, proceed with caution, reduce speed, and keep a safe speed for road, weather, and traffic conditions.
- SB 8 (signed March 23, 2025, enforced from mid-2025) created a NEW section, codified as K.S.A. 8-15,116, 'Unlawful passing of a stationary vehicle' — not an amendment to the older emergency-vehicle statute 8-1530 that other summaries cite. The new section is what makes Kansas cover any hazard-lit vehicle.
