Who you move over for, and the fallback
- Move over for: Stopped police and other authorized emergency vehicles, tow trucks, and highway incident-response vehicles, all running flashing lights. Not a plain disabled car with its hazards on.
- If you can't move over: On a road with two or more lanes your direction, drop below the posted limit and move into a lane not next to the stopped vehicle when it's safe. On a two-lane road, slow below the limit and hold a safe speed until you're past.
- Statute was broadened past just police to include authorized emergency vehicles, tow trucks, and highway incident-response vehicles. Still no coverage for a regular disabled vehicle showing only hazards. Idaho sets no fixed slow-down mph; it's 'below the posted limit' at a safe speed.
What a violation costs
Infraction, about $90 and 3 points on a first offense. No fixed escalation in the statute, but hit or hurt a responder and you face separate, far more serious charges.
