Since January 1, 2025 you move over for everything on the shoulder (Fla. Stat. § 316.126). Emergency, tow, utility, and now any disabled vehicle with hazards, flares, or a person standing by it. Move over a lane, or slow to 20 mph under the limit if you can't. It runs about $60 base, near $150 with court costs, and 3 points.

What is the move-over law in Florida?
On a multi-lane road, vacate the lane closest to the stopped vehicle. If you can't move over, slow to 20 mph below the posted limit, or to 5 mph if the limit is 20 mph or less.. You must do it for Police, fire, EMS, tow, utility, and sanitation/maintenance vehicles. Since Jan 1, 2025 it also covers ANY disabled vehicle stopped with hazard lights, emergency flares, posted emergency signage, or a person visibly present. A flat tire counts., including any disabled vehicle with its hazards on. See Fla. Stat. § 316.126.
