Who you move over for, and the fallback
- Move over for: Any stopped vehicle displaying alternately flashing lights or warning lights, police, fire, EMS, tow trucks, and a disabled car with its hazards on.
- If you can't move over: On a highway with four or more lanes (two your direction), move into a lane not next to the stopped vehicle if you can do it safely. If you can't, slow down to a safe speed for conditions.
- Statute reaches any stationary vehicle giving a signal by alternately flashing lights or warning lights, which a disabled car's hazard flashers satisfy, so it covers stranded motorists too. Penalties are civil, escalating on repeats within five years.
What a violation costs
Civil penalty of $275 first offense, $500 for a second within 5 years, $1,000 for a third or later within 5 years. Harm a responder and you face separate criminal charges.
